Office Action

An office action takes place when you or your representative file a trademark application, but if the EUIPO threatens to reject it because one or more of the so-called absolute grounds of refusal occurs. In such a case you get a notification about the reasons. Most of the time the EUIPO thinks that the trademark has no distinctiveness or it is deceptive, or maybe they’ve seen problems with the class specification. Instead of losing hope immediately contact us and we’ll observe the reasoning and come up with possible countermeasures to help the trademark getting registered. We’ll discuss it with you and you can decide how to proceed. We’ll prepare the reply to the Office according to this decision of yours.

Opposition

When you file your application and the EUIPO approves it they eventually publish the application. This way other businesses with trademarks can see it and if someone thinks that consumers will mix up their trademark with yours, these businesses may file an opposition against your application. If this happens only the representatives of these businesses should communicate with each other – otherwise it can turn ugly pretty quickly. If these problems are handled by legal firms professional ethics would dictate that they’ll try to solve the issue with each other peacefully. These cases most of the time end with a win-win consensus. Of course oppositions work the other way around as well – you yourself can start legal actions through us against other marks.
